Financial Conversations with Fitz #21 - Groundwater Bill NOT Delayed - 06/02/2009
It is spring/summer!!!! Ground temperature is finally above 66 degrees. Corn and beans are growing. Now we just need lots of sun.
I want to remind people about our 17th annual Hospice of North Iowa Golf Open…It is held on Saturday, June 6, at the Bear Creek Golf Course in Forest City. I can’t believe that June is here so soon. Along with the hospice tournament we have Winnebago and neighboring County Relay for life events. Worth County Fair is June. I looked at our Community Room calendar this morning and it has something going 12 different times this month. Give us a call if you need a great place to meet.
A surprise from post legislature that will have an impact on our counties is that Chet Culver vetoed the extension of the July 1st deadline for Septic Tank Inspections for acreages. YOU WILL HAVE TO BE INSPECTED if you want to record a deed involving an acreage this July 1st. The DNR will be the regulator on this. You will need to see your county sanitation in Kossuth..Jack Bradley, Hancock…Steve Anderson or in Winnebago see Ron Kvale. The law is short says if you have a septic tank you will need to be inspected and pumped out before recording. So we are having a seminar for our local realtors, attorney, bankers and other interested parties on June 11th at our TSB community room. If your acreage has put in a new septic system since 2000 you should be OK. If it has been in the ground for a long time, you could have some issues with where it drains and how long since it has been pumped out. It can not drain into a drainage ditch or stream from your tank. There are currently about 166 inspectors state wide. So if you have an acreage to sell or buy you need to get in touch with your banker, realtor or attorney. If you have to start from scratch you need to do a lot of things in a short while. We even have a situation that is scheduled to close on July 2nd. They now have to get inspected before the deal can be completed. You can call us or your county recorder if you have an immediate question. Some of the forms are being finalized as we speak. Your inspection will be attached to the Groundwater Hazard Statement that we file. The systems have to at least 1000 gallon with a 200 feet absorption field to be working and pass thru. They definitely want to eliminate the direct drainage into a ditch. There is no grandfathering on this one. WE are all learning together on this one in a short time, eventho we knew a year ago it might happen. There will be an additional cost involved if you need a new tank (1500 gal) and a drainage field of at least 400 ft. That can run about $6,000 to $10,000 depending on several factors. There are a few exemptions with family transfers, foreclosures, estates, divorce and other unique transactions. If you want to read up on the entire bill just go to http://www.iowadnr.gov/tot.html .
Remember that you should deal with people in community banks and organizations that when they put something together for you that they will be sitting with them at ball games, church or community events. So, if in doubt give us a call.
